Tax Classes in Germany Explained

Post Views: 5,774

If you’re an employee in Germany, you will see the term „Lohnsteuerklasse“ on your paycheck. This is a number that refers to your Tax-Class, based on this your taxes are calculated. Not only the tax rate, but also social insurance and solidarity contributions and church tax are calculated based on this Tax class. Your net salary, as an employee is therefore, based on your tax class. This applies only to employees and not self-employed persons

How to find your Tax Class

Once you arrive in Germany and register yourself (Anmeldung), a tax class is assigned to you by the Finanzamt based on your marital status.

In the German tax system there are a total of six different wage Tax classes, which are based on the family situation of the individual taxpayer. If you already know your tax class, you will receive further information by clicking on the respective button. The table below shows the details of which tax class you could belong to.

STEUERKLASSE - 1

Tax Classes in Germany

This is the default tax class that is applied to single (unmarried) people; couples who live in a civil partnership (registered) who are divorced, widowed or married. Once married, you should apply for a change of tax class and would automatically be moved to 4&4. Some married couples can be in Classes 3&5. People under this Class pay high Tax in comparison to other Tax category.

IMPORTANT: If you are married and your spouse lives in home country, then you will be still put in the CLASS 1, Germany accepts the tax class change, only when your spouse landed in germany, get registered in the aliens office and applied for the tax class change.

STEUERKLASSE - 2

Tax Classes in Germany

This tax class is for single parents who live alone with their children and entitled to Kindergeld benefits. Some of them are applicable to other benefits from the government as well.

STEUERKLASSE - 3/5

Tax Classes in Germany

STEUERKLASSE -3 This tax class is for married couples, when one spouse has no income, lower income than the other or chooses to be in Tax class 5. It also applies to windowed employees for the year of death of the spouse. Read below to understand the benefits of being classified under Classes 3&5. Spouse earning higher than other partner must choose this Tax class.

STEUERKLASSE -5 This is the counterpart to the tax class 3. one can choose this combination, when the other spouse chooses to be in Tax class 3, the other is automatically assigned Tax class 5.

STEUERKLASSE - 4

Tax Classes in Germany

This is the default tax class for married couples, who have not chosen Classes 3&5.  If both the couples earn almost equal amount, then it doesn’t make sense to shift to 3/5 or 5/3 class combination, because you don’t save any amount significantly here. As soon, you get married and registered in einwohnermeldeamt, you will be put to tax class 4, so its your duty to change the tax class, see here to know, how to change the Tax class

STEUERKLASSE - 6

When an employee has a second job and earns more than 450€ per month on this job, he is under Tax Class 6.

Benefits of Tax Class 3&5

If you are married and your spouse lives in Germany, then you can choose different tax classes and reap benefits. This way, you can optimize your tax return. The default tax class for married couples is Class 4 but you can benefit from being assigned Class 3&5.

If one spouse earns significantly higher than the other, it is understood that they are bearing most of the household costs – hence getting a tax rebate for this reason. If you are in this situation, you can move to Tax Class 3 and receive more net salary than being in Class 4.

When one spouse chooses to be in Class 3, the lower earner is automatically assigned Tax Class 5. This situation is the most beneficial when one spouse earns at-least 60% of the total income of the household.

Registration in Germany – First Step

In Germany, irrespective of the nationality, one must register his or her place of residence with your current address at the citizen office (Bürgerbüro) in the town-hall (Rathaus)and is one of the most important and foremost things to be done when moving into Germany.

Why is it important

According to German Law, one must register in Germany as mentioned in Section 17 of the German Federal Registration Act. You have a timepreiod to register yourself within the firsr 14 days of moving to Germany or to a new address. In case you don’t get yourself registered a legal action can be taken against you and regardless of that you can’t get a mobile sim, health insurance or any services at the bank without first registering yourself at the new place. So it’s because of these reasons that a lot of emphasis is done on finding a place as early as possible and then registering yourself to this new address.

How long does it take?

Depending on the city you’d probably have to wait a few hours to get to your turn and present the person at the desk with your documents. Including your rental contract and identity such as your passport. The officer enters this details in their record and gives you a certificate for registering (Meldebescheinigung or Anmeldebestätigung) to that particular address. To avoid the waiting, it is possible to get an appointment with the citizen office of your city by googling ‘Meldebehörde Anmeldung Termin’ with the name of your particular city.

Who needs to Register?

  • Everyone who are living in Germany more than 3 Months
  • Anyone changing address within Germany.
  • Anyone who are planning to work or Study in Germany
  • Anyone who wants to open a Bank account, Health Insurance, TAX ID, Mobile Connection.

Commerzbank Girokonto

What you need to register yourself?

To prepare for your visit for registering at the Rathaus

  • you need to make sure you have a contract in your name from the landlord and a confirmation ‘Wohnungsgeberbestätigung’ from the landlord.
  • In case you are subletting the place again you need a confirmation ‘Wohnungsgeberbestätigung’ from the original tenant or the landlord .
  • If you’re staying with a friend or some family members temporarily while looking for a place for yourself, you would need a signed letter stating that you are staying with them.
  • You would require to fill the registration form (Anmeldung bei einer Meldebehörde) which can be found in the waiting area of the town-hall or could also be downloaded from their website.
  • Proof of your ID is required in the form of passport or ID card along with proof of valid visa or residence permit if you’ve already gotten it.

If you are living in Germany for less than 3 months, then you don’t need to get yourself registered. In that case your valid visa is enough for to get some things done but you can’t get an internet or electricity contract and for a mobile contract you would have to rely on a pre-paid one.

What happens after registering your residence in Germany?

Once you are officially registered in Local Rathaus, you will also have to pay fees for German broadcasting in the future. This needs to be paid every month irrespective you own a Television or Radio. Fees do not vary based on the number of Households rather the amount is for the complete House. More Details, check the below link www.rundfunkbeitrag.de .

If you are moving to new city, then Kindly update he new address to the Rundfunk service.

What is Home Contents Insurance?

Home Content insurance covers everything movable in your house. In other words, imagine turning your house upside down, everything that would fall out, for example, the furniture, kitchen utensils, electronic items or your wear-able are insured by home content insurance. This insurance is necessary in the case of loss of your valuable belongings, theft or substantial damage to your home by a natural calamity like a storm or a flood. Experts for consumer protection and police recommend taking home contents insurance. Especially during vacations and in winters when the cases of burglaries are high.

Misconception

Renters don't need insurance: Many renters mistakenly assume that their landlord's insurance policy will cover their personal belongings. However, the landlord's insurance typically covers only the structure of the building and not the tenant's possessions. It is crucial for renters to have their own home contents insurance to protect their belongings from theft, damage, or loss.

Situations Covered

Home content insurance  insures your Own belongings. Things included in the Home contents insurance are:

  • Furniture, clothing and household appliances.
  • Cash in your house and Valuables that are locked in a safe.
  • Jewellery, Gemstones and watches present in the household.
  • Certificates and Securities.
  • Things in a second home for professional use.

Remember, all of your belongings are insured only in certain conditions. Generally, the conditions included in Home content insurance are:

  • Damage to electronic appliances due to lightning.
  • Fire, lightning, explosion, implosion, aircraft.
  • Damage from Power Fluctuations.
  • Damages from Burglary, Vandalism and Robbery.
  • Theft in the Workplace of your belongings during opening hours.
  • Tap water damages or the one caused due to leaking from aquariums, water pipe damage or water bed.
  • Storm and hails.
  • Internal unrest, strike or lockout.

In addition to the above, many companies will not only take care of the charges associated with the damaged items but also will cover any costs for:

  • Repair cost from burglary or water damage.
  • Cleaning of the damaged property and the cost to move your items to another location (if necessary).
  • Hotel Expenses- In case the household is uninhabitable due to damages.
  • Data recovery cost if your software or hardware gets damaged because of any of the above-listed conditions.

IMPORTANT

  • Cycle Theft and Glass Breakage are additional components required to be activated and this is not included in the base component.
  • Price of the Insurance varies on individual factors. Size of the House, Location. One cannot give a generalized price for this Insurance

SITUATIONS NOT COVERED

  • Subtenants Household stuffs
  • Accessories of Motor vehicles and their trailers such as stored tires, machines etc.
  • Building components
  • Valuables in vacation or weekend homes (Some providers provide this as an additional option).

EXAMPLE Scenarios

Scenario 1: On a fine day, you start cooking your food, and suddenly a parcel arrives for which you have been waiting for a few days. In the excitement to open it and receive it, you forgot to turn off the stove and get involved in checking the items. After some time you realize that a fire has started because of this negligence and your kitchen is damaged. In such a case, your insurance provider will cover your damage.

Scenario 2: While you were enjoying a vacation, someone was able to break through your house and stole all your valuable belongings including some cash and electronics worth thousands of Euros. In such cases, having home content insurance would help you to incur the loss.

Scenario 3: Due to a water leak at your place, water gets accumulated in your house. Because of it, some of your furniture gets destroyed, and you can not use them further. In such cases, your insurance provider will help you with replacing the necessary items.

Points to consider while taking Online

Insurance providers often provide a limited backup for home content insurance in case of different situations. Depending on the size of your house and your plan, the coverage value would vary. Also, there are circumstances in which this insurance may not stand valid, like:

  • If you live in a furnished apartment (belonging to the owner) and the furniture gets destroyed due to any reasons, home content insurance will not cover the damage. You will need liability insurance to get them insured.
  • Theft of anything valuable from your cars like cash or jewelry
  • Damages caused by pets.
  • Uninsured water damages- groundwater, stagnant or flowing water.
  • Landslide, avalanches, heavy rainfalls and other such natural calamities
  • Self-inflicted damage

Is This necessary?

This Insurance is important for the people who have their own household contents. Household insurance may be worthwhile if they cannot easily afford to buy additional furniture, electrical appliances, clothing, etc.

How to Report?

First foremeost steps to be done before proceeding.

  • Report the Damage to the Insurer
  • Explain the situation, how the damage happened
  • Photos of the Incidents must be documented and sent to the Insurance company

According to §BGB 823, you are liable if you damage someone else property

Situations Covered by Liability Insurance

While taking insurance, it is necessary to understand what is covered. Listed here are the important aspects of liability insurances.

  • Damages to borrowed, rented and hired property
  • Protection of things against uninsured third parties (Forderungsausfalldeckung)- If another party causes damage to you, they do not own insurance and can’t pay for you, then your liability insurance pays for you.
  • Loss of work or private keys (Schlüsselverlust) *You should check with your insurance provider if this is available as an add-on or is inclusive in the insurance.
  • Personal and property damage
  • Damages through internet use
  • Football, cycling, skiing and more sports.

In addition to the above, you can sign up for these additional coverage packages depending on your requirements(Zusatzpakete):

  • Tierhalter-Haftpflichtversicherung (pet liability insurance)- This can be a requirement by your dog training schools or landlords to cover any damages.
  • Haus- und Grundbesitzerhaftpflichtversicherung (house and property owner liability insurance) – This is only for those who own an apartment.
  • Auslandsaufenthalt (coverage abroad) – Insures you when you travel outside Germany. Coverage may vary in the EU region and outside the EU region.
  • Passiver Rechtsschutzversicherung (passive legal insurance)– This covers the legal cost for your defence if someone tries to claim any damages not caused by you.
  • Bauherrenhaftpflicht und Bauleistungsversicherung (house construction)– If you are getting your house constructed, this insurance will cover damages on and to your construction site.

SITUATIONS NOT COVERED

  • Damages own object: For Eg: you break your own phone, you need a Electronic Insurance for this
  • Damages in Work: you need Professional Liability Insurance.
  • Damages to the Car: You need an individual Car Liability Insurance.
  • Damages due to Dog: you need a Dog Liability Insurance

EXAMPLE Scenarios

Scenario 1: While practising for a football/cricket match or any other sport, if you by mistake hurt your team-mate, liability insurance will cover all the medical cost on your behalf.

Scenario 2: With a single main entrance to an apartment or a facility, you get the keys to access the main door. If you accidentally drop keys somewhere and lose them, the lock will have to be changed, and you will have to pay for the new one. It can be heavy on your pocket, but liability insurance takes care of it.

Scenario 3: If you use bicycles or electric bicycles and you accidentally hit a person or cause any damage to a property owned by someone else, then liability insurance will help you.
